Lost Profits is a broad term used to describe a business’s failure to realize anticipated profits due to the actions of an individual or entity, such as a party to a contract, or the occurrence an unanticipated event, such as a fire or other casualty. Lost profits experts are frequently retained by one or both sides to calculate, quantify, and/or comment on the amount that would restore the injured business to the economic position it was expected to achieve “but for” the actions of the offending party, in essence assessing whether the numbers reflect reality. Although the legal measure of such “benefit of the bargain” damages varies somewhat among jurisdictions, typically the fact of damages must be proven with reasonable certainty, but the amount of damages need only be reasonably estimated.
