Often used interchangeably with “inadequate security”, security negligence refers to a defendant property owner or occupier having provided security measures, but is alleged to have provided the security in a negligent manner at the time of a past incident, e.g., inadequately trained security personnel, non-working or unmonitored security equipment, etc. Security experts retained by one or both parties typically assess the security provided at the time of the incident in the context of the defendant’s own security program, applicable industry and security standards, plus any applicable laws or ordinances.
